تحقیق حاضر تحت عنوان ((بررسی ماهیت دیه)) در صدد بود به سوالاتی پیرامون نوع ماهیت دیه پاسخ دهد ولی درنهایت با نقد دو دیدگاهی که به وحدت ماهیت دیه نظر دارند، بدین قائل گردید که دیه ماهیتی تلفیقی دارد، بدین معنا که دیه به‌طور کامل نه قابل تطبیق با جزای مالی است و نه خسارت مدنی. لذا دیه، هم جنبه مجازات و هم جنبه خسارت به خود می‌گیرد تا از یک‌سو مانع از ارتکاب قتل و جرح و اتلاف جان و مال دیگران شود و از سوی دیگر ضرر و زیانی که به شاکی وارد شده است نیز جبران گردد
یکی از جهات مهم در بحث دیه ماهیت حقوقی آن است که آیا پرداخت دیه از باب مجازات است یا از باب ضرر و زیان و خسارتی که به مجنی علیه وارد شده است، یا این‌که دارای هر دو جنبه است و ماهیت دو گانه دارد. نکته دیگر این است که آیا روشن شدن ماهیت حقوقی دیه دارای آثار عملی در احکام خواهد بود یا نه و اگر دارای آثار است باید دید چرا در کتاب‌های فقهی درباره آن بحث و گفت‌وگو نشده است و اگر اثر و نتیجه‌ای در حکم ندارد باید جهت فروعاتی که بر روشن شدن بحث شده است راه چاره‌ای جست‌و‌جو کرد. در این تحقیق دلایل خسارت بودن و مجازات بودن دیه را بررسی می‌کنیم و سرانجام به آثار و راه حل‌های ارائه شده برای مسائل مربوط به آن می‌پردازیم.
